1. Acceptance of Terms
By accessing or using the KAWAI Network ("Protocol", "Network", "we", "us", or "our"), including our web interfaces, documentation, APIs, and the decentralized peer-to-peer network, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our services.
2. Eligibility
You must be at least 18 years of age to use the KAWAI Network. The use of our decentralized peer-to-peer infrastructure involves interactions with cryptographic tokens, wallets, and smart contracts that entail financial risk. We do not knowingly permit persons under 18 years of age to participate.
3. Nature of the KAWAI Network
KAWAI is a decentralized, peer-to-peer network protocol for AI compute. We provide the software and interface, but we do not operate the nodes, provide the underlying compute resources, nor process the AI models independently.
- Non-Custodial: The KAWAI Network is fundamentally non-custodial. We do not hold, control, or manage your private keys, seed phrases, or digital assets. You are solely responsible for the security of your wallet. We cannot recover lost funds or keys.
- "As-Is" Service: All interfaces, software, and services are provided strictly "AS IS" and "AS AVAILABLE" without any warranties. We do not guarantee continuous, uninterrupted, error-free operation, or that the AI compute results provided by decentralized nodes are accurate, valid, or free from malicious tampering.
4. No Financial or Investment Advice
Nothing contained in our websites, documentation, or applications constitutes financial, investment, legal, or tax advice. Past performance or estimated returns (such as APY, compute mining rewards, or token valuation) are purely hypothetical algorithm calculations. You participate in the Network at your own risk.
5. Acceptable Use Policy
Because the KAWAI Network facilitates the running of AI models globally, it is imperative that users abide by strict ethical guidelines. You agree NOT to use the Network or its compute nodes to:
- Generate, distribute, or host malware, ransomware, or any other destructive code.
- Create, solicit, or disseminate Child Sexual Abuse Material (CSAM) or any content exploiting minors.
- Conduct illegal activities, including fraud, money laundering, or the facilitation of terrorism.
- Infringe upon the intellectual property rights, copyrights, or trade secrets of third parties.
- Generate malicious deepfakes, large-scale disinformation campaigns, or non-consensual explicit content.
6. Guidelines for Contributors and Miners
If you connect your computing resources (GPUs/CPUs) to the KAWAI Network as a Contributor ("Miner" or "Provider"), you accept the following:
- Rewards and Slashing: Rewards for providing compute are determined algorithmically. By participating, you acknowledge that protocol enforcement mechanisms may "slash" (penalize/burn) your staked tokens or withhold rewards if your node performs malicious actions, provides invalid inference results, or fails to meet uptime requirements.
- Liability for Hosting: You assume the risks associated with running external, decentralized workloads on your local hardware.
7. Limitation of Liability
To the fullest extent permitted by law, KAWAI, its developers, affiliates, and representatives shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses resulting from:
- Your access to or use of (or inability to access or use) the services.
- Unauthorized access, use, or alteration of your transmissions or content.
- Bugs, vulnerabilities, exploits, or failures in the underlying blockchain protocols or smart contracts.
8. Modifications to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
